A Federal High Court judge, Justice Ahmed Mohammed, yesterday, struck out the suit filed by Speaker of the House of Representatives, Aminu Tambuwal, challenging the withdrawal of his security details by the Inspector General of Police (IGP) following his defection to the All Progressives Congress (APC). This is following an application for discontinuance moved by counsel to the speaker, Dr. Tunji Abayomi, who said he was instructed by his client to withdraw the suit.
Counsel to the Attorney General of the Federation (AGF) and the IGP, Ade Okeaya Inneh (SAN), who did not oppose the application, however, asked the court to dismiss the suit and award cost against Tambuwal because parties had joined issues in the case by filing counter-affidavit and reply on the merits of the suit. In his ruling, Justice Mohammed said since the defence only reacted to the motion for interim injunction to restrain the IGP from withdrawing Tambuwal’s security details and not the motion on notice, the court would not dismiss the suit or award cost against the plaintiff.
