DINO MELAYE: “MILITARIZATION OF OUR ELECTIONS IS ILLEGAL & UNCONSTITUTIONAL”!

Following the deployment of military for elections which INEC has supported by backing an amendment of the Electoral Act, APC chieftain/former Kogi lawmaker, Dino Melaye has said he will be dragging President Goodluck Jonathan. Melaye made this disclosure in a series of tweets today saying: ” The militarization of our elections by GEJ is illegal and unconstitutional. I am going to court on Tuesday to stop it hence forth.It is illegal and ultra vireos on the part of GEJ to deploy the armed forces to maintain law and order during elections.

“Section 215 & 217 of the 1999 constitution limited the only condition to military involvement in civil issues to police incapacitation.It is only when law and order has been completely broken down beyond the capacity of the police that army can be invited.In cases where govt anticipate break down of law and order is preemptive and illegal. Their job is to suppress insurrection & aid the police.

“The constitution of this country lack powers to involve soldiers in maintains law and order.Section 305 of the constitution that gave GEJ powers to deploy armed forces in the North East needed a state of emergency ratified by NASS. has been settled by the court of Appeal in the case of Yusuf vs Obasanjo in 2005. (18 N.W.L.R(pt 956) 96. It was clearly declared that Military have no business in civil matters,including the conduct and processes of elections.

“It is the duty of d police to protect our nascent democracy & not d military otherwise democracy may be wittingly or unwittingly militarized.This is not what the citizens bargained for in wrestling power from the military in 1999- Justice Salami JCA.Conscious step or steps should be taken to civilianize the polity to ensure the survival and sustenance of democracy.The abuse and mis-use of the military and armed forces in general by Mr President and indeed the pdp must stop forth with.”
